Update: What HUD’s Policy Shift Means for Emotional Support Animals

Earlier this year, Ohio Animal Advocates reported on changes at the U.S. Department of Housing and Urban Development (HUD) affecting how the agency handles housing complaints involving emotional support animals (ESAs).

As advocates continue to examine the policy, one distinction is especially important: the Fair Housing Act has not changed.

My Dog Is My Home recently highlighted this distinction following HUD's decision to deprioritize certain assistance animal cases and withdraw longstanding guidance used by housing providers and advocates.

While these actions have created uncertainty around federal enforcement, they do not eliminate the Fair Housing Act or automatically end reasonable accommodation protections for people who rely on emotional support animals.

As My Dog Is My Home explains, advocates can and should continue supporting people who need assistance animals to maintain safe and stable housing.

For Ohioans facing housing discrimination or questions about an emotional support animal, state and local protections may also apply. Fair housing and disability rights organizations can help individuals understand what protections are available in their specific circumstances.

Ohio Animal Advocates will continue monitoring developments affecting pet-inclusive housing, disability accommodations, and the human-animal bond.
